Terms and Conditions

The Bombay Art Society (BAS), is a registered charitable institution founded in 1888 incorporated under public trust act 1953. www.bombayartsociety.org (referred hereinafter as BAS website, we or us) is maintained by The Bombay Art Society.

The artwork images, text, illustrations, audio/video clips, or any other material on the website is protected by copyright act and is not allowed to be copied, reproduced, reposted, transmitted, distributed, in whole or in part in any form whatsoever, without the prior written consent of The Bombay Art Society. We reserve all rights with us.

The artworks made available on the BAS website for sale do not imply that these artworks are always in the physical possession of  The Bombay Art Society and may be located anywhere in the world. In rare cases, the particular artworks may not be available if purchased few hours before you placed an order for them.

We make all reasonable efforts to display the artworks on the website with the accurate description such as title, medium, size, year, and price. We also try to match the actual colour of the artwork on the monitor screen. In few cases, the minor variations in the description, pricing and colour difference due to screen resolutions or for any other reasons may not be ruled out. BAS do assume any responsibility towards any such errors.  In the event of description error if any, BAS reserves the right to cancel the order placed by the Buyer by informing him/her before shipping the artwork ordered.

The artworks prices listed here include 12% GST but  does not include duties, packing, forwarding and shipping cost, which will be charged separately as applicable depending on the physical location of shipping address of the Buyer. The default address provided during registration or updated at the time of purchase shall be treated as the final billing and shipping address.

By placing an order, it is warranted that you are providing us with accurate and truthful information such as your name, address, email Id etc that may be used to contact you and courier you the artwork ordered; The Bombay Art Society does not assume any responsibility if inaccurate information provided by you unintentionally or otherwise leads to your losses.

By placing a buy order, it is presumed that the Buyer agrees to pay taxes, duties and shipping cost etc mentioned above in addition to the listed price of the artwork and arranges to pay it separately before shipping the artwork to the address provided.

Apart from the price of the artwork, the Buyer is required to make additional payment withing 7 working days towards, insurance premium unless specified otherwise, shipping charges applicable for international deliveries etc. The Bombay Art Society reserves the right to cancel the order if aforesaid charges and taxes are not received within 7 working days as mentioned above.

The buyer of the artworks is responsible for duties and taxes outside India; please note that all the artworks, collectibles entering any foreign country are subject to customs inspection and assessment of the duties and taxes if any in accordance with that country’s laws. The buyer shall pay the duties if any directly to the shipping company or their affiliates.

The registered name and address of the buyer used for raising invoice should match with the name and account from where payment is received for purchase; the mismatch in names may result in shipment delay until the name variations are confirmed and accepted by BAS.

You are responsible for maintaining the confidentiality of username/password of your payment gateway  login account if any, and accept responsibility for all activities that occur under your account and password.  BAS never asks to share your username and password and you should not disclose it to anyone if you receive calls for it.

The order placed on the BAS website, unless cancelled by BAS, constitutes an irrevocable acceptance of the purchase. By placing an artwork order, the buyer by default enters into the sale contract with The Bombay Art Society (an intermediary of the seller).

The artwork(s) will be shipped to the Buyer only after full payment has been realised including additional charges with the completion of required documentation as requested by The Bombay Art Society.

We always suggest for transit insurance and include the insurance premium in the additional cost, unless buyer advises otherwise. Buyer is responsible for filing insurance claims if any with carriers for damaged and/or lost shipments.

The artwork is to be collected from BAS office within two weeks if the Buyer choses to collect the artwork himself/herself from BAS office communicated to the buyer. Failure in collecting the artworks within two weeks will result in additional storage cost which buyer might have to pay upon artwork collection.

By registering or providing your email Id, your consent is presumed for receiving updates and announcements from us on The Bombay Art Society editions and new artwork arrivals, BAS newsletter etc. However, you can request to stop such updates, newsletters any time by clicking unsubscribe any time.

We guarantee for Authenticity of all the artworks displayed on the BAS Website and provide authenticity certificate from the seller who can be artist, art gallery or The Bombay Art Society. The tax invoice provided will always be from The Bombay Art Society,  in INR or equivalent amount in USD for overseas buyers.

Though we can try for physical inspection of artworks either at our office or affiliate art galleries, The Bombay Art Society is not obligated to provide any physical preview of the artwork either before or after the sale.

All the artworks made available on the BAS website are in good condition, however, virtual The Bombay Art Society is not liable for the condition of the artworks, collectibles etc for any minor or consequential damages resulting from the use of artworks. The condition report from the seller of respective artwork can be provided on request. If  BAS considers that the difference in the physical condition of the artwork and the appearance on the Website of the same artwork is significant, the Buyer will be intimated so and his/her decision will be awaited for order execution and shipping the artwork.

Cancellation and Refund Policy

Cancellations will be considered only if the request is made within 3 hours of placing an order provided the same is informed in writing at bombayartsociety@gmail.com /  rajendra.art@gmail.com followed by a call on +91 7400009978 in case of no reply from our side by mail within 3 hours. However, the cancellation request will not be entertained if the orders have been communicated to the exhibiting art galleries or artists and they have initiated the process of shipping them. For all cancellations made as above, the refund will be processed within 15 working days.

Refund Policy

When buyer place buy-order for artworks, it constitutes the irrevocable purchase of the said artwork and we do not provide a money-back guarantee for purchases made on our website. However, if the buyer did not like the artwork for any reason and not entirely happy with the purchase made, we provide ‘One-Week’  artwork replacement guarantee with the “new artwork of the same price by the same artist or same art gallery” from whom the purchase is made on our website. However, all such replacements provided as a goodwill gesture are to be conveyed to us at bombayartsociety@gmail.com / rajendra.art@gmail.com with a week from the date of delivery of the artwork to the buyer. The shipping charges and customs taxes if any are to be borne by the buyer for such free replacement of purchased artwork with the new artwork as mentioned above.

However, www.bombayartsociety.org provides 100%  refund (excluding shipping and customs taxes) to the Buyer if the artwork is delivered to the Buyer in damaged condition. In case of damaged artwork delivery, please follow below procedure.

  • Intimate bombayartsociety.org within 12 hours of delivery of the artwork at bombayartsociety@gmail.com / rajendra.art@gmail.com or call/message us on +91 7400009978.
  • Please email us detailed nature of damage with photographs of the artwork at bombayartsociety@gmail.com / art@gmail.com
  • Our representative will get in touch with the buyer within to two working days and intimate the next course of action like arranging to collect the damaged artwork, claiming insurance etc.
  • Please preserve the packing crates of damaged artworks for inspection.
  • Refunds in damaged artwork delivery cases if any will be processed within 15 working days after the receipt of damaged artwork from the buyer.

The Bombay Art Society shall not be liable for any direct or indirect damages of whatever nature resulting from the use of BAS website, interruptions due to traffic and erroneous text or content etc.

The Bombay Art Society reserves the right to cancel any order placed on www.bombayartsociety.org   prior to the delivery of the artwork, without assigning any reason whatsoever.

Buyers’ information provided to The Bombay Art Society remains confidential and is governed by the terms of our ‘Privacy Policy’.

The Bombay Art Society reserves the right to block the registered user if found to be using the website contrary to laws of the land or for other than intended purpose.

The terms and conditions of website use are governed by Indian laws and are subjected to the law enforcement agencies, courts within Mumbai jurisdiction to resolves disputes if any, even though seller or buyer is located anywhere in the world.

Terms and Conditions, Privacy Policy, and Authenticity together form the rules of BAS website use. Please refer all three.

The BAS website users agree to observe and abide by the terms and conditions stated herein. We reserve the right to modify, change or issue new terms & conditions at any time without prior notice, and assume that users review these terms & conditions as and when they use the website.
